Terms and conditions

These are the terms on which Waiste supplies its waste operations software to a waste business. They cover the software subscription, not bin hire. If you are a customer of a waste business that runs on Waiste, the terms that apply to your bins are that business's own, published on their web address, not here.

Who these terms are between

They are between Waiste, which supplies the software at waiste.ai, and the waste business that opens a workspace on it. In these terms that business is called the operator.

Waiste is an Australian business name, not a company. The full legal operator line is published here once it is confirmed; until then the contracting party is Waiste at waiste.ai, contactable at support@waiste.ai.

What Waiste provides

A hosted, multi-tenant operating system for a waste business: bookings, run planning, a driver app, customers, assets, invoicing and reporting, with the modules the operator turns on.

Each operator's data is held in its own database schema and served only on the web addresses registered to that operator. Waiste does not show one operator's data to another, and does not use one operator's data to serve another.

Waiste does not guarantee uninterrupted service. It is software delivered over the internet and it has outages, maintenance and dependencies. Where the service is unavailable, tell us at support@waiste.ai and we will say what happened.

The operator's side

The operator is responsible for what it does with the software: the accuracy of its own prices, the quotes and invoices it issues, the messages it sends its customers, and its own compliance with the law that governs waste collection and consumer contracts.

The operator is responsible for its own users. Anyone the operator gives access to has the access the operator granted, and the operator must remove people who should no longer have it.

The operator must not use the software to send messages it has no lawful basis to send, to hold data it has no lawful basis to hold, or to impersonate anyone.

Fees

The monthly fee and the card fee are the ones shown when the operator signs up, inclusive of GST.

The card fee is taken from each card payment a customer makes through Waiste. Nothing is taken on bank transfer or cash.

At signup the operator chooses how its customers pay. Card payments starts with 6 months with no monthly fee; invoices and bank transfer starts with 1 month.

After the free time the monthly fee is charged to the operator's saved card on the same day each month.

An operator's prices change only with notice, from a later billing day, never retrospectively.

Late payment

If a subscription invoice is not paid, the workspace goes read only 14 days after the due date: the operator and its drivers can still see everything, and nothing new can be created.

If it is still unpaid 21 days after the due date the workspace is suspended. Suspension stops access; it does not delete data.

Paying the outstanding amount restores access.

Cancelling

An operator can cancel at any time. Cancellation takes effect at the end of the month already paid for, and the workspace runs normally until then.

There is no lock-in period and no exit fee.

The operator's data, during and after

The operator's data stays the operator's. Waiste holds and processes it to run the service and for no other purpose.

An operator can export its data while the workspace is active. On request within 30 days of cancellation Waiste will provide an export.

After that period Waiste deletes or de-identifies the workspace's data, except records it must keep by law, such as tax records of what the operator was charged.

Liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy the Australian Consumer Law gives and that cannot lawfully be excluded.

Beyond those rights, Waiste's liability for any claim connected with the service is limited to the subscription fees paid for the three months before the claim arose, and Waiste is not liable for lost profits, lost business or indirect loss.

The operator is liable for its own dealings with its own customers.

Changes to these terms

Terms change. Each version is published at this address with its own version date, and the version in force is the one shown at the top of this page.

A change that materially affects an operator is notified before it takes effect, and continuing to use the service after that date is acceptance of it.

Law

Australian law applies, and Australian courts have jurisdiction.
